Right To Recall Sarpanch Haryana[edit]
Right To Recall Sarpanch Haryana is proposed law in the state of Haryana. This law will empower gramsabha to remove the existing Sarpanch before the term. This bill was introduced in Aug 2020 by Deputy Chief Minister Dushyant Chautala. Due to some hurdles, it is going to be introduced in upcoming winter session now.
[1]Dushyant Chautala said it was the dream of former Deputy Prime Minister Devi Lal that people should have the right to recall a representative of the public if he or she loses confidence of people. Chautala said if a panchayat member misuses his position or fails to meet expectations, people will have the right to recall him after one-year tenure by voting for a candidate of their choice.[2]
RTR and Instability[edit]
The govt claims that this will empower citizens and gramsabha to recall underperforming Panchayat members. But critics like SY Quraishi the former election commissioner have long said provisions in the bill may cause instability.[3]
Similar concerns about Right To Recall causing instability were raised by Pranab Mukherjee and H. R. Bhardwaj.[4][5]
Other States having Recall laws at Panchayat level[edit]
Recall has been implemented at Panchayat level in the states of Uttar Pradesh, Uttarakhand, Bihar, Jharkhand, Madhya Pradesh, Chhatisgarh, Maharashtra and Himachal Pradesh
Right To Recall Sarpanch is also proposed for Haryana.
The procedure of Recall over Sarpanch is a 2 step procedure which can be directly initiated by the citizens. After a lock-in period of 1–2 years varying from state to state, certain number of voters of the Gram Sabha need to submit their signatures / thumbprints and petition the Collector office. After verification of the signatures, a meeting of all the Gram Sabha members is organized and if majority of the Gram Sabha votes against the sitting Sarpanch, the Sarpanch is removed.
Failure of Influence of Right to Recall laws at Panchayat level[edit]
Right to Recall has been in vogue in Uttar Pradesh since 1947 and in Madhya Pradesh for over a decade now but not exercised much at Gram Panchayats level, due to lack of awareness.
In spite of villagers in these states having direct power to remove their Sarpanch, the corruption done by Sarpanch of these states is high and widespread.
