Mark Anthony Niemczyk (born 8/28/1946 or 12/01/1942?) is an American criminal who gained national media notoriety when he was convicted in 2013 of felony theft by deception for his 9/11 truck scam, which occurred from mid 2010 to mid 2012, when he and accomplice Thomas Scalgione were arrested in New Jersey. Niemczyk, who falsely claimed to be a 9/11 first responder and also used stolen valor in the scam by falsely claiming to be a retired Navy SEAL, was first exposed by retired Navy SEAL Don Shipley on his YouTube channel, becoming a “Phony Navy Seal of the Week” in 2011.[1]

The pair sold T-shirts (which they obtained from manufacturers at reduced prices by falsely claiming to be a charity) and collected donations, first at Ground Zero in New York City and later at 9/11 commemorative events and other related events using a truck painted with Twin Towers and decaled with all the names of FDNY firefighters who died on 9/11. Niemczyk pled guilty to the charges in 2014 and was sentenced to 5 years probation.

In 2023 he was identified and confronted on video while operating a version of the scam on Fremont Street in Las Vegas, which had apparently been going on since 2015 or 2016. This confrontation and later efforts to expose his scamming activities are documented on the "Exposing Mark Niemczyk" social media accounts on YouTube, TikTok, Facebook, and Instagram.
