2023 New Year pardons

On 31 December 2023, Chilean President Gabriel Boric made use of a discretionary power Law 18.050 confers to presidents of the republic and pardoned thirteen convicts.[1][2] Initially, eleven pardonees were announced but this was soon corrected with the addition of two more convicts.[3]

The pardoned convicts were all men in the age span of 21 to 48 years.[2] Among the pardonees is Jorge Mateluna, a former member of Manuel Rodríguez Patriotic Front who was serving a sentence for robbing a Santander bank in 2013.[1][2] Boric has expressed his belief that Mateluna is innocent of the 2013 robbery.[4] Mateluna had previously been detained and tried in 1992 for illicit association under the Chilean antiterrorism law. He was pardoned for this in 2004 during the Government of Ricardo Lagos.[5]

Other pardoned convicts were serving time for arson, plunder and attempted murder against police in the context of the massive 2019–2020 Chilean protests.[1][2] Previously Boric had supported a failed law project in the Senate of Chile to grant amnesty to convicts related to the protests.[2]

The pardons drew criticism from the right-wing parties National Renewal and Independent Democratic Union.[1] Deputies of the opposition parties National Renewal, Independent Democratic Union and Evópoli left a cross-partisan public security board in protest.[6]

One of the pardoned convicts was detained again on December 14, 2023 on the charges of extorsive kidnapping and violent robbery.[7]
