András Nemescsói (Hungarian: Nemescsói András; 21 June 1977, Budapest –) attorney at law, partner at DLA Piper Posztl, Nemescsói, Györfi-Tóth and Partners Law Firm (DLA Piper Hungary), chairman of the Board of Directors of the Hungarian Investor Protection Fund (IPF), member of the Advisory Committee and the Committee of Issuers of the Budapest Stock Exchange.

Early life and education[edit]

He studied at the Faculty of Law and Political Sciences at Pázmány Péter Catholic University, where he graduated with summa cum laude in 2000.

His research on the subject of the effects of the Economic and Monetary Union on the sovereign bond markets and public debt management won first place in the National Scientific Students' Associations Conference. The research and his scientific activity performed throughout his academic years was later honored by the Hungarian Academy of Sciences with a Pro Scientia Gold Medal.

In 2002, he studied at Universita Cattolica del Sacro Cuore, ASERI Postgraduate School of Economics and International Relations in Milan, where he acquired a postgraduate degree in economics and international relations.

Legal career[edit]

Following his graduation, he started working at the Hungarian Financial Supervisory Authority[1] as a legal specialist at the department of brokerage firm investigations. He later became the deputy director of the Supervisory Department of Capital Market's Major Institutions and Unusual Events at the Hungarian Financial Supervisory Authority.

Under his direction, the first extensive investigation into the Budapest Stock Exchange and KELER Central Depository Ltd.[2] was carried out, and he also played a role in the detection, as well as the investigation of the "Pannonplast-case" (later referred to as the K&H brokerage scandal). After passing the bar examination in 2004 he joined DLA Piper Hungary. In 2009, he became international partner of the Litigation and Regulatory practice group at DLA Piper, of which he is currently head. The Legal 500 listed him as one of the "leading individuals" of banking, finance and capital markets in Hungary.[3]

Since 2007, he has advised, among others, on the Jeremie programme,[4] representing the Hungarian state in many investment protection disputes in international arbitration proceedings (ICSID and ICC). He advised the Hungarian Central Bank during the reorganization and sale of MKB Bank. He represented the Soros Fund Management, which is under the ownership of George Soros in the judicial challenge of a record-high-value supervisory fine imposed by the Hungarian Financial Supervisory Authority on the grounds of an alleged market manipulation. In addition to the above, he is participating in the organization of a conference and workshop series on business transparency in cooperation with the American Chamber of Commerce (AmCham).[5]

In 2016 he was invited to the Advisory Committee and the Committee of Issuers[6] of the Budapest Stock Exchange, and since July 2016 he has been the chairman of the Board of Directors of the Hungarian Investor Protection Fund.[7]

  • Betfair Group;  Headlong/Sporting Odds (Sportingbet), Gala Interactive; Colossusbets, Betit, Penn National Gaming Inc. - Advising major international online betting service providers in lawsuit portfolios (a total of 80+ cases) against the Hungarian Gambling Authority.[8]
  • Ministry of Agriculture and Rural Development / Agency for the Administration of the National Land Fund - Representing Hungary in connection with an ICSID claim brought by three British investors - Magyar Farming Ltd, Inicia Zrt and Kintyre Kft - active in the farming industry in Hungary.[9]
  • Hungarian Government - Le Chèque Déjeuner and C.D Holding Internationale brought an action against Hungary in front of ICSID alleging that Hungary enacted certain measures in connection with the regulation of the social voucher business in Hungary which had an expropriatory effect on their investments.[10][not in citation given][11][not in citation given]
  • Pfizer Gyógyszerkereskedelmi Kft. Hungarian subsidiary of Pfizer Inc. - Representing Pfizer in a litigation where the side effects of Champix, a smoking cessation medicine is investigated.[12][not in citation given]
  • Hungarian Government - Sodexo Pass International SAS initiated an ICSID arbitration against Hungary claiming that Hungary expropriated its investment in the meal voucher industry by enacting certain general reforms of the taxation system.[10][not in citation given][13]
  • Hungarian Government - Representing Hungary in connection with the annulment of an award rendered by an ICSID tribunal in December 2016. The award in question was rendered in favour of French social voucher issuer Edenred SA.[14]

Personal life[edit]

He is married to Zsuzsanna Martonyi (daughter of János Martonyi, the former Hungarian Secretary of State) and is the father of four children. Besides Hungarian, he also speaks English and German.[citation needed]
