On February 4, 2014, a California Highway Patrol police officer arrested on-duty firefighter Jacob Gregoire for an alleged parking violation during an emergency rescue operation.[1]

Gregoire was quickly released without charge.

The event caught national and international attention, prompting complaints from fire service leadership.

Gregoire later filed a claim for damages against the police force.

People involved

At the time of his arrest, Jacob Gregoire worked for California's Chula Vista Fire Department as an engineer and had been employed for twelve years.[2] He was aged 36 years at the time of his arrest.[1]

Gregoire was arrested by police officer Sergio Flores, who had worked for California Highway Patrol for nineteen years at the time of the arrest.[3]

Arrest

Around 9pm on February 4, 2014, Gregoire was providing medical aid to victims of a vehicular collision and rollover on the Interstate 805 highway[1] near Telegraph Canyon Road.[4] One vehicle was on its roof after hitting the median.[5]

After engineer Gregoire refused to move his fire truck, a California Highway Patrol officer arrested him, handcuffed him, searched his pockets and seated him in the rear of a police cruiser.[1] The arrest was witnessed by news media.[1] Gregoire was released after 30 minutes[6] with no charges being filed.[7]

Aftermath

The event attracted national attention and prompted San Diego County Fire Chiefs Association to describe the event as an "aberration".[8] Chula Vista fire chief Dave Hanneman stated that Gregoire parked his vehicle in a manner to protect an ambulance from oncoming traffic, aligned with protocol.[5]

After the event, leadership of the police highway patrol and the fire department met to discuss the incident.[9] The discussion led to a review of the communications protocol between the two agencies.[10]

In March 2014, Gregoire filed a legal claim against the California Highway Patrol.[11] That same month, Gregoire's Dan Gilleon said that Gregoire was willing to settle the court case if the police promised to not interfere with the work of firefighters.[12][13]

The trial court granted California Highway Patrol's motion for summary judgment on the cause of action of intentional infliction of emotional distress, and denied summary judgment on the other claims.[14] The United States Court of Appeals for the Ninth Circuit heard an oral argument to dismiss the case on December 2017.[15]
