The Azerbaijan Energy Regulatory Agency regulates and inspects issues related to electricity, gas and heat supply.[1][2]
History[edit]
Established with the Presidential Decree N 1750ç dated 22/12/2017, the Agency operates as a public legal entity under the Ministry of Energy. After abolition of two supervision departmens under the Ministry of Energy of the Republic of Azerbaijan as the State Energy Control Department and the State Gas Control Department of the Ministry of Energy, their assets and liabilities passed to the Agency.
In April 2018, the Agency started its governance.
AERA consists of the Board, departments, divisions and units operating in the headquarters of the Agency, as well as via its branches located in the regions of the Republic of Azerbaijan.
Functions[edit]
AERA is a national regulatory agency, that is responsible also for technical inspection (supervisory) over companies carring out their businesses in electricity and heat industries and also gas supply industry, as well as over consumers.
Legal bases for the regulatory fees to be paid to the Agenncy[edit]
The following laws have been amended in order to stipulate the mandatory regulatory fees to be paid to the Agency:
- Law On energy;
- Law On electricity;
8 Law On gas supply;
- Law On electrik and heating plants.
To ensure the financial independence of the Agency, the Rules for calculating and paying the amount of fees paid by enterprises operating in the field of electricity, heat and gas supply to the Energy Regulatory Agency are coordinated with the President of the Republic of Azerbaijan and approved by the Ministry of Energy on 5 March 2018. On 1 March 2018, the staff list and cost estimates of the Agency were approved by the Order No. 26 of the Ministry of Energy.
In accordance with the Agency’s Charter (Articles of Association), the Rules for control in the field of electricity and heat, as well as gas supply are approved by Presidential Decree No. 204 dated 16/07/2018 for stipulation of control procedures are due to be carried out by the Agency.
Branches network[edit]
AERA currently has 11 branches located in Baku, Ganja, Sumgayit, Lankaran, Shirvan, Mingachevir, Sheki, Tovuz, Khachmaz, Kurdamir and Imishli cities. Each of branch names has the name of city where it is located.
The service areas of these branches is determined in clauses 1.7 of the Branch's statutes, approved by the Order No. F-79 of the Ministry of Energy dated July 9, 2020.
For encompassion of the de-ccupied (liberated) territories in Karabakh region of the Republic of Azerbaijan, these branches' service areas are extended by Order of the Ministry of Energy No. F-28 dated March 30, 2021 as follow:
Kelbajar region is included into the Ganja branch's service areas; Shusha and Khankendi cities, Jabrayil, Gubadli, Zangilan, Lachin, Khojavend and Khojaly regions are included into the Imishli branch's service areas.
Furthermore, taking into account the workload of the branches and inter-district distances, for assuring more affective services the folowings alterations are put into operation:
Aghdam region is excluded from the Imishli branch's and included into the Mingachevir branch's service areas; Zardab region is excluded from the Imichli branch's and included into the Kurdamir branch's service areas; Gabala region is exluded from the Kurdamir branch's and included into the Sheki branch's service areas.
