Brien A. Roche
Brien A. Roche (born 1949) is an American attorney and author based in Northern Virginia.[1] He has practiced law since 1976 and is admitted to the bar in Virginia, Maryland, and the District of Columbia.[2] Roche is known for his work in personal injury law, legal education, and authorship of several legal reference books used by both practitioners and the general public.[2]
Early life and education
Roche received his Bachelor of Arts degree from Georgetown University. He earned his Juris Doctor in 1976 from the George Washington University National Law Center. From 1970 to 1976, he served in the United States Marine Corps Reserve. Between 1971 and 1975, he worked as a uniformed patrol officer with the Metropolitan Police Department in Washington, D.C.[2]
Legal career
Roche began his legal career representing insurance companies in civil litigation. After ten years of defense work, he transitioned to plaintiff personal injury law. He has handled a wide range of civil litigation cases, including medical malpractice, premises liability, wrongful death, nursing home injuries, and police misconduct claims.[2]
Since 1986, Roche has served as a Commissioner in Chancery for the Circuit Court of Fairfax County, Virginia,[3] acting as a judicial officer in equity matters.[2]
Notable Cases
- Schwartz v. Brownlee – A medical malpractice case appealed to the Virginia Supreme Court where the verdict for $1.85 million was upheld and the doctor’s professional corporation was found to be liable.[4]
- Carmello v. Cockerill – A wrongful death and personal injury action involving the death of a 12 year-old girl and serious injury to her father from a tree falling on a public roadway. Roche and his client sought to change the law in Virginia that property owners alongside public roadways do have a duty to inspect and maintain trees that are at risk of falling on passing motorists. The Virginia Court of Appeals and Virginia Supreme Court refused to change the existing law on that issue.[5]
- Berwyn Fuel v. Hogan – A D.C. Court of Appeals decision involving personal jurisdiction.[6]
- Prendergast v. Northern Virginia Regional Park Authority – A property damage claim upholding sovereign immunity.
- Bowers v. May – An auto crash case involving the concept of contributory negligence in a rear-end accident case. [8]
- Sheridan v. Nationwide Retirement Services – A contract action where the trial court improperly granted summary judgment and the Court of Appeals reversed.[9]

He has held an “A” rating from Martindale-Hubbell since 1986, reflecting the highest peer review rating for both legal ability and ethical standards.[1]

- Virginia Domestic Relations Case Finder (LexisNexis) - A 400 page reference book compiling domestic relations decisions from Virginia courts.[23]
- Objections: Interrogatories, Depositions and Trial (Virginia Law Foundation) - Co-authored and widely used in the courtroom and in continuing legal education (CLE) seminars across Virginia.[24]
- Law 101 (Sphinx Publishing) - A legal guide for non-lawyers, with over 30,000 copies sold.[25]

Personal life
Roche and his wife raised their seven children in Northern Virginia, where he continues to live and practice.[2]
