The Copyright Tribunal of Australia is an independent body established by the Copyright Act 1968 to determine remuneration and other conditions for statutory and voluntary copyright licensing schemes and to resolve related disputes. The Tribunal is administered by the Federal Court of Australia, which provides registry and corporate support.[1][2]
Jurisdiction and functions
The Tribunal has jurisdiction under the Copyright Act 1968 to confirm, vary or substitute licensing schemes and to determine equitable remuneration and conditions payable under those schemes, including those operated by declared collecting societies. Matters commonly concern educational copying, government copying and music and broadcast licensing.[3][4][5]
Composition
The Tribunal consists of a President, any number of Deputy Presidents and other members appointed by the Governor General. The President must be a judge of the Federal Court of Australia. A Deputy President must be, or have been, a judge of a federal court or a State or Territory Supreme Court. Other members must meet statutory qualifications.[1][6]
Procedure and powers
The Tribunal may refer a question of law to the Federal Court of Australia. It is not bound by the rules of evidence and may inform itself as it thinks fit, and it may make costs orders in any proceeding. Appeals and judicial review are available under the Copyright Act 1968 and the general law.[1][7][8][9]
Administration and hearings
The Tribunal has no physical resources of its own and is supported by Federal Court staff for registry and administration. Hearings are conducted in Federal Court facilities and are listed on the Tribunal website.[1][10]
