Derrick Brent is an American lawyer, engineer, and patent official who served as Deputy Under Secretary of Commerce for Intellectual Property and Deputy Director of the United States Patent and Trademark Office (USPTO) from 2022 to 2024 and briefly served as acting head of the agency after the departure of Kathi Vidal.[1][2]
Education and early career
Brent earned a Bachelor of Science in mechanical engineering from Ohio State University and a Juris Doctor from Northwestern University Pritzker School of Law. Before becoming a lawyer, he worked as an engineer for General Motors.[1][3]
Legal and government career
Before joining the USPTO, Brent served in all three branches of the federal government. He clerked for Judge Algenon L. Marbley of the United States District Court for the Southern District of Ohio, served as a senior trial attorney in the United States Department of Justice Civil Rights Division, and worked as counsel to Senator Barbara Boxer.[1][4]
In the private sector, Brent worked as an associate at Vorys, Sater, Seymour and Pease LLP and as vice president and associate general counsel at Masimo Corporation. A profile published by the UC Davis Business Law Journal described his work as focused principally on litigation and policy involving intellectual property, civil rights, employment, and commercial law.[4]
USPTO
The USPTO announced Brent's appointment as deputy director in July 2022, effective August 1, 2022. The agency stated that the deputy director served as principal adviser to the under secretary and director and helped manage an agency with more than 13,000 employees.[5][2]
After Vidal announced that she would leave the USPTO in December 2024, Inventors Digest reported that Brent would lead the agency on an interim basis as acting Under Secretary of Commerce for Intellectual Property and acting Director of the USPTO.[6] He was succeeded in the acting role by Coke Morgan Stewart in January 2025.[7]
