Division of Chemistry
The Division of Chemistry of the United States federal government was established in 1862 as a division of the Department of Agriculture. The Division of Chemistry was originally concerned with soil analysis but soon expanded into food safety. Chemist Charles M. Wetherill was appointed by Abraham Lincoln as the first director.[1] A generation later, in 1883, Harvey W. Wiley M.D. was appointed Chief Chemist at the USDA. Wiley helped transform the agency and soon became a nationally renowned crusader for food and drug safety regulation. After 1889, the Division of Chemistry expanded to cover analysis of food, drugs and insecticides. It was re-designated as the Bureau of Chemistry on July 1, 1901.[2]
In 1906, the Bureau of Chemistry was "charged to enforce the first comprehensive federal statute of its kind," the Pure Federal Food and Drugs Act.[3]
An Act for preventing the manufacture, sale, or transportation of adulterated or misbranded or poisonous or deleterious foods, drugs, medicines, and liquors, and for regulating traffic therein, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That it shall be unlawful for any person to manufacture within any Territory or the District of Columbia any article of food or drug which is adulterated or misbranded, within the meaning of this Act; and any person who shall violate any of the provisions of this section shall be guilty of a misdemeanor, and for each offense shall, upon conviction thereof, be fined not to exceed five hundred dollars, or shall be sentenced to one year’s imprisonment, for each subsequent offense and conviction thereof shall be fined not less than one thousand dollars or sentenced to one year’s imprisonment, or both such fine and imprisonment, in the discretion of the court.[4]
