Flightright GmbH is a German claims management company that enforces passenger rights against airlines in cases of flight disruptions.[1] The claims the company pursues are derived from the European Regulation No. 261/2004, under which passengers are entitled to cash compensation when boarding is denied to them or when their flight is cancelled or significantly delayed in the EU. By frequently bringing related legal questions before the European Court of Justice, Flightright contributes to delineating the scope of European passenger rights.[2]

History

Flightright was founded as a startup in Germany in 2010 by Philipp Kadelbach, a lawyer who had previously specialized in IT law.[3] Over the years, it has considerably grown in size and meanwhile operates in eight different countries, including the United Kingdom and the United States.[2]

In 2019, ownership of the company was transferred to the media firm Intermedia.[3]

Products and services

Flightright claims compensations for flight disruptions pursuant to Regulation (EC) No. 261/2004 on behalf of affected customers.[4] It determines the eligibility of individual passengers through an online form on its website.[5][6] This initial assessment of cases is offered as a free service. If Flightright recognizes that a flight disruption entitles users to compensation, they may commission the company to assert their claims in return for a purely performance-based fee.[7] Once an airline agrees to pay the compensation it owes, Flightright forwards it to its customers. In exchange, the company deducts its success fee from this sum to pay for its services.[8][9] Under these terms, Flightright reportedly processes half a million cases per year and had already enforced claims worth more than €200 million in total until 2019.[1]

In any promising case in which an airline rejects an out-of-court settlement, Flightright, or rather the law firm it cooperates with, files a lawsuit.[10] On numerous occasions, the company's legal action has led to preliminary rulings by the European Court of Justice that have essentially concretized the conditions under which passengers are entitled to compensation.[11][12][13][2]

Flightright offers its services to passengers of disrupted flights departing or arriving in any major European country.[1][14]
