ID5 Forum

ID5 Forum is a non-commercial cooperative framework among five major industrial design intellectual property offices: the China National Intellectual Property Administration (CNIPA), the Korean Intellectual Property Office (KIPO), the Japan Patent Office (JPO), the United States Patent and Trademark Office (USPTO), and the European Union Intellectual Property Office (EUIPO). Together, these offices process the majority of the world’s industrial design applications, representing about 90 percent of global filings.[1]

History

The ID5 Forum was launched in December 2015 to promote international cooperation and harmonization in the protection of industrial designs.[2]

Objectives

The Forum aims to:

  • Improve efficiency and interoperability of design systems.
  • Enhance quality and consistency in examination and registration practices.
  • Adapt design protection to emerging technologies such as digital and virtual designs.
  • Facilitate the exchange of information and best practices.
  • Raise awareness and transparency regarding design rights.[3]

Membership and observers

The Forum consists of five permanent members: CNIPA, KIPO, JPO, USPTO, and EUIPO. The World Intellectual Property Organization (WIPO) participates as an observer, linking ID5 discussions with the international framework of the Hague Agreement on Industrial Designs.[4]

Projects and activities

The ID5 undertakes cooperative projects and comparative studies to align practices and provide guidance to users. Examples include:

  • User Guide on View and Drawing Requirements, comparing representation standards among offices.[5]
  • Development of systems for the electronic exchange of priority documents.[6]
  • Comparative studies on partial designs, new technology and digital designs, term of protection, and remedies for infringement.[7]
  • Workshops on the Hague Agreement, focusing on differences in procedure and practice.[8]

As of 2022, the Forum had completed more than 16 cooperative projects and studies, many of which are publicly available.[9]

Meetings

The ID5 holds an annual meeting, hosted on a rotating basis by the member offices, to review progress and set future work. In addition, mid-term meetings and thematic workshops are held on issues such as artificial intelligence, the metaverse, and digitalization in design protection.[10]
