This appears to be a dodgy legal justification that is championed by the ultra-conservative lawyers that wanted to help Donald Trump illegally overturn a free & fair election for POTUS. It didn't work in 2020/2021. Perhaps a law that makes it repellent to those who would consider trying to overthrow the will of the electorate. You may say there already are laws on the books to deter such behavior, but I would be forced to remind you that both Jeffrey Bossert Clark & John Eastman (not to mention Donald Trump himself...among others) attempted (allegedly) to subvert The USA's democracy with just such a legal strategy, and none of the aforementioned people were held to any sort of account for it. Soon, in upcoming elections, others will undoubtedly attempt to perpetrate the same sort of foolishness, unless there is a price to pay for it.
