From 2008 to 2020, Cunningham was a law professor at St. John's University School of Law.[1][5] He is a scholar of higher education, judicial ethics, and insurance law, among other topics.[5] In 2015, while working an associate dean at St. John's University School of Law, Cunningham was quoted in an AP interview as calling for the resignation of the chief of police of Ferguson, Missouri, following a government report recording a pattern of racial profiling at the department.[4] In 2016, in response to the killing of a lowland gorilla named Harambe, he was quoted by the AP as agreeing with the decision not to prosecute the mother because "the purpose of the criminal law is not to punish someone for accidents".[6]
On June 30, 2020, Cunningham succeeded Andy Abrams as dean of the Charleston School of Law.[1] He was later promoted to dean and provost.[3]
