In 1988 Michael D. Esplin was appointed to represent Archuleta on capital homicide charges.

The facts alleged by the state were that Archuleta and an accomplice picked up the victim in Cedar City, tied him up with chains, put him in the trunk of their car, drove to a remote location in Millard County, removed him from the trunk, tortured him, and then killed him. Although Archuleta was sentenced to death for his part in the alleged crime, and has had execution dates set for his execution following the denial of his initial appeals to the Utah Supreme Court and the United States Supreme Court, he is still pursuing[1] post-conviction relief in the appellate courts.
