Moushumi Bhattacharya (born 27 October 1967) is an Indian jurist who is serving as permanent judge of Calcutta High Court (CHC) since 16 September 2019.[1][2][3]

Early life[edit]

Bhattacharya was born on 27 October 1967 in Kolkata. She attended Loreto House in Calcutta and received a B.A. with Honors in English from Jadavpur University before completing her LL.B. at the University of Calcutta in 1996. She also earned her L.L.M. (1999) at the University of Cambridge.[4]

Career[edit]

Bhattacharya was enrolled as an advocate in the Bar Council of West Bengal on 19 November 1997. She practiced in the High Court of Calcutta, the Supreme Court of India, the High Court of Delhi, the High Court of Judicature in Patna, and the High Court of Judicature in Hyderabad. [4]

She was elevated to the Bench of the High Court of Calcutta as an Additional Judge on September 21, 2017.[5] She was appointed as member of National Legal Services Authority since 2023.[6]

The Supreme Court has issued a gender-just handbook for judges in August 2023, which includes a number of positive measures. A draft created by Bhattacharya, Justice Pratibha Singh (Delhi High Court), and Professor Jhuma Sen, under the guidance of Chief Justice of India D.Y. Chandrachud, recommends the deletion of archaic phraseology such as "spinster," "seductress," "mistress," as well as "eve teasing."[7]

Judgements[edit]

During a trial of 2022 Coal scam case, she ordered Enforcement Directorate (ED) to summon Maneka Gambhir, the sister-in-law of Abhishek Banerjee (nephew of Chief Minister Mamata Banerjee) on September 5, 2022. Bhattacharya directed the ED to question Gambhir at its zonal office in Kolkata in September or whenever she is summoned. The ED refused Gambhir's request for relief, arguing that classified documents related to her questioning are in Delhi and cannot be brought to Kolkata.[8]

In June 2023, Bhattacharya has overturned 26 Covid-era orders issued by the West Bengal Clinical Establishment Regulatory Commission that fixed rates to be charged by private hospitals and advisories for a wide range of services, including pathological laboratory tests, hospital admission, and bed charges, calling them "arbitrary, unjustifiable, and without basis" and "without rationale".[9]
