Najibullah Amin (Dari: نجیب‌الله امین; born July 1976) is an Afghan legal scholar, author, and former government official known for his contributions to legal education, public sector reform, and governance.[1] He has taught International Criminal Law at the Faculty of Law of Kabul University and held senior government positions, including Undersecretary for the Cabinet, Commissioner for Civil Service Reform, and Chief Rapporteur for the Constitutional Loya Jirga.

Early life and education

Amin was born in Kabul, Afghanistan, to Mohammad Amin Wardak, a retired Major General of the Afghan National Army. He completed his primary and secondary education in Kabul and studied Law at Kabul University. He later earned a master's degree in Law and Economics from the University of Bologna[2] and a PhD from Leiden Law School at Leiden University.[3]

Since early 2025, Amin has focused on research on rebel-to-state transitions, especially regarding the Taliban and Afghanistan’s governance since 2021. He is based at the Centre for International Conflict Analysis and Management (CICAM)[4] at Radboud University.[5]

Career

Amin began teaching at Kabul Law School in 2002, covering International Criminal Law, General Criminal Law, and Theoretical Criminology until August 2021.

He simultaneously held senior government roles. Between 2002 and 2004, he led research for the Constitutional Drafting and Review Commissions and later served as Chief Rapporteur for the Constitutional Loya Jirga that adopted the 2004 Constitution of Afghanistan. He coordinated several Loya Jirga assemblies from 2009 to 2019.[6]

From 2010 to 2014, under President Hamid Karzai, Amin served as Undersecretary for the Cabinet and Deputy Director General of the Office of Administrative Affairs.[7] In 2017, he was appointed Commissioner for Civil Service Reform and Director General of Civil Service Appointments.[8] Between 2020 and 2021, he was Senior Legal Advisor to the Afghan embassy in The Hague and the Afghan government’s focal point to the International Criminal Court.[9]

After August 15, 2021, Amin returned to academia, joining first the Van Vollenhoven Institute (VVI)[10] and later CICAM at Radboud University.

Recognition

Amin has received several Afghan presidential awards, including First Grade Certificates and the High Government Medals of the Conquerors Maiwand Ghazi Mohammad Ayoub Khan and Ghazi Wazir Mohammad Akbar Khan.[11] He has also been recognized by international organizations, including The Asia Foundation.[12]
