Rafael Retamal López (16 August 1906 – 11 September 1992) was a Chilean lawyer and judge who served as a justice of the Supreme Court of Chile from 1966 to 1992 and as president of the Supreme Court from 1983 to 1988.[1]

He was also a member of the Constitutional Court of Chile from 1971 until its dissolution in 1973.[2]

Early life and education

Retamal was born in Talca on 16 August 1906. He studied at the Faculty of Legal and Social Sciences of the University of Chile, where he received the Montenegro Prize as the best student of his class. He qualified as a lawyer on 20 August 1930.[2]

Judicial career

Retamal entered the judiciary on 18 June 1936, when he was appointed judge in Parral. He was subsequently appointed a judge in San Fernando on 7 November 1945. In 1949, he was transferred to Santiago, where he served as a judge in courts of major jurisdiction.[2]

On 16 September 1953, Retamal was appointed a justice of the Court of Appeals of Santiago. His service on that court is also documented in records of the National Congress of Chile from 1956, in which he appears acting as a minister of the Court of Appeals.[2]

Retamal was appointed a justice of the Supreme Court of Chile on 2 June 1966.[2] The historical roster of the Supreme Court compiled by the Chilean judiciary records his membership of the court from 1966 until 1992.[1]

Retamal was also a member of Chile's first Constitutional Court. He served on the court from 1971 until 1973, alongside Enrique Silva Cimma, Jacobo Schaulsohn, Ramiro Méndez Brañas, Adolfo Veloso Figueroa and, later, Israel Bórquez. Retamal participated in several of the court's decisions; a 1973 judgment, for example, records him as one of the members of the Constitutional Court presided over by Enrique Silva Cimma.[3]

President of the Supreme Court

On 18 May 1983, Retamal was elected president of the Supreme Court by the court's plenary session, receiving twelve votes against one for Luis Maldonado Boggiano. His term was established to run until 17 May 1988.[2] He succeeded Israel Bórquez, who had served as president since 1978.[1]

Official records confirm Retamal's exercise of the presidency during this period. An August 1983 auto acordado issued by the Supreme Court was signed by him in his capacity as president.[4]

In October 1984, the Supreme Court, under Retamal's presidency, considered reports concerning actions by personnel of the Central Nacional de Informaciones in cases involving petitions for amparo. The court instructed appellate courts to direct criminal judges on measures concerning persons detained or arrested by state security services.

Retamal remained president into 1988. An auto acordado adopted on 18 January of that year records the full Supreme Court as meeting under the presidency of its titular president, Rafael Retamal López.[5]

His term ended in May 1988 and he was succeeded by Luis Maldonado Boggiano. Retamal nevertheless remained a justice of the Supreme Court until 1992.[1] He occasionally acted as president of the court after leaving the permanent presidency; an October 1991 plenary session, for example, records him presiding in his capacity as acting president.[6]

Retamal died in Santiago on 11 September 1992.
