The State Service for Antimonopoly and Consumer Market Control under the Ministry of Economy of the Republic of Azerbaijan (Azerbaijani: İqtisadiyyat Nazirliyi yanında Antiinhisar və İstehlak Bazarına Nəzarət Dövlət Xidməti) — is a state body that responsible for strengthening business competition, preventing and reducing anti-competitive activities. It also ensures state control over public procurement, technical regulation, quality management, consumer rights protection and etc.[1] [2]

Formation[edit]

The State Committee for Antimonopoly Policy and Support to Entrepreneurship was established for the first time in Azerbaijan by the President's Decree No. 3 of June 23, 1992. The Statute of the Committee was approved in August of that year.[3]

In 2001, the Committee was incorporated into the Ministry of Economic Development and was called the Department of Antimonopoly Policy. On December 28, 2006, the Antimonopoly State Service was established under the Ministry of Economic Development and the functions of consumer market control were assigned to the Service.

In 2009, the Antimonopoly Policy and Consumer Rights Protection State Service were established. Duties and rights related to antimonopoly activity, unfair competition, natural monopolies, advertising, and consumer market control were assigned to the institution.[4]

On April 20, 2018, the Antimonopoly and Consumer Market Control State Agency was established, which was included in the structure of the Ministry of Economy. The State Committee on Standardization, Metrology, and Patents was placed under the authority of the Service. [5] With the decision dated October 23, 2019, the agency was again granted the status of public service. On December 19 of the same year, the Antimonopoly and Consumer Market Control State Service were included in the structure of the Ministry of Economy.

The State Procurement Agency of the Republic of Azerbaijan, which was established on May 16, 1997 by the Decree of the President of the Republic of Azerbaijan dated January 15, 2016, and which implements state policy in the field of procurement of goods (works and services) at the expense of state funds in the Republic of Azerbaijan, is the former central executive authority. The agency was dissolved, and its duties, functions, and state property were given to the State Service for Antimonopoly Consumer Market Control under the Ministry of Economy of the Republic of Azerbaijan. The charter of the State Service was approved by the Decree of the President of the Republic of Azerbaijan dated May 12, 2020.[6]

On December 23, 2021, Mammad Abbasbeyli was appointed Head of the State Service.[7]

Regarding organizational structure, the State Service for Antimonopoly and Consumer Market Control includes 8 regional divisions: Absheron, Ganja-Gazakh, Sheki-Zagatala, Lankaran, Guba-Khachmaz, Aran, Daghlig Shirvan, and Yukhari Karabakh.

The State Service cooperates with international institutions in order to exchange experience on regulation, application, and other areas of activity. These are as follows: CIS, GUAM, the European Accreditation Organization, the Organization for Accreditation Cooperation of International Laboratories (ILAC), the International Organization for Standardization (ISO), the European Standardization Committee (CEN), the International Legislative Metrology Organization (OIML), the CIS Interstate Council on Standardization, Metrology and Certification (IGC), the Institute of Standardization, Standards and Metrology Institute for Islamic Countries (SMIIC), and others.
