Andrew T. Miltenberg

Andrew T. Miltenberg (born April 28, 1965) is an American trial lawyer[1] and a pioneer of conducting Title IX lawsuit against colleges and universities.[2] He is the co-founder and managing partner of the law firm Nesenoff & Miltenberg, LLP.[3]

Education[edit]

Miltenberg completed his B.A. at Emory University and his J.D. at Brooklyn Law School.

He is admitted to U.S District Court in the Eastern and Southern District of New York.[4]

Career[edit]

Miltenberg has been working in the real estate industry with business conglomerates. As an attorney, he has had victories before the Second and Seventh Circuit Courts of Appeals. Miltenberg’s lawsuit challenges the failure of institutions to uphold constitutional due process and the gender orthodoxy that is responsible for violating these principles in the first place.[5]

Currently, he defends male students accused of sexual misconduct on campus[6] with established offices in New York and Boston.[7] Miltenberg advocates for reforming the Title IX civil rights regulations during Trump's reign, which was by the Obama administration's presumed guilty policies, on the face of accusations, devoid of adequately investigating the onslaught of the assault allegations.[8][9][10]

Miltenberg sits on the Board of Directors at The Town Hall N.Y.C.[11] and Families Advocating For Campus Equality (FACE).[12]

He has appeared on podcasts such as The Bold Sidebar and Non-Stop Talk, where he has talked about Title IX.[13][14]

Miltenberg was a panelist at the annual Conversation and Action series held at Wilson Hall (2019).[15] He was invited as a speaker at Roger Williams University School of Law.[16]

Notable cases[edit]

Miltenberg recently filed a Title IX class-action lawsuit against Michigan State University for suspending a male student on gender biases following Obama administrated sex assault investigations policy.[17]

He represented New Orlean's writer and film-maker Stephen Elliott, with a defamation lawsuit for appearing on an anonymously crowdsourced Google spreadsheet list. Elliott had got maligned as Shitty Media Men with alleged campus rape and sexual harassment accusations.[18][19] Later, the judge ruled on the case in Stephen Elliott's favor and allowed the lawsuit to move forward.[20]

He defended Paul Nungesser, subjected to gender discrimination by Columba University, on alledged rape accusations by Emma Sulkowitz in 2012, with a Title IX lawsuit settlement.[21]

Miltenberg fought for Alec Klein, the former Northwestern journalism professor, allegedly accused of sexual harassment, abusive behavior, and bullying by Medill School students and staff.[22]

Miltenberg initiated the legal battle for the NFL player Matt Boermeester and filed a lawsuit against USC in United States District Court for expulsion based on third party witness reports.[23]

A former prosecutor, Linda Fairstein, consulted Miltenberg to file a federal defamation lawsuit against the creators of a Netflix series When They See Us.[24]

Miltenberg represented the family of musician Nils Lofgren in a case against senior housing facility for patient negligence leading to positive COVD-19 results.[25]

He represented Grant Neal, a student athlete at Colorado State University-Pueblo (CSU-Pueblo) who was suspended for sexual assault.[26][27][28]

Miltenberg represented a former N.F.L. Player Keith Mumphery who was being persecuted for false sexual misconduct allegations.[29][30]

He represented John Doe, a student expelled from the University of Colorado’s Boulder campus after a CU investigator determined that he had sexually assaulted two women.[31]

Miltenberg is married to Jennifer, and they reside in Franklin Lakes, New Jersey.[32]
