Carlos Fernandes is an inventor, founder and CEO of RecordTV Pte. Ltd. that offers Cloud DVR (iDVR) Service that is now branded as InstantTV. Fernandes was the primary inventor of the Cloud DVR and was awarded a patent for the underpinning invention, "A System and Method for recording television and/or radio programmes via the Internet".[1] RecordTV's Cloud DVR was also the first to successfully withstand legal challenge and be declared legal by any court in the world as recognised by the law firm Olswang.[2] He's been considered to be the inventor of the world's first legal Internet/Cloud DVR.[3][4][5]

Early life[edit]

Fernandes was born in Mumbai. In a profile done by Streats, Fernandes has been quoted as saying he got his first taste of business when he was 12 and sold water purifiers door-to-door.[citation needed]

Career[edit]

Kent Ridge Digital Labs[edit]

In 1998, Fernandes joined[6] the then-named Information Technology Institute, a government research institute that was subsequently renamed Kent Ridge Digital Labs and most recently renamed again to Institute of Infocomm Research,[7] which is a research institute run by Singapore's Agency for Science Technology and Research. In 1999, he joined a Kent Ridge Digital Labs spin-off, Ecquaria where he decided to become an entrepreneur. He explained:[6]

I found myself not only selling software but also writing it myself. That experience led me to believe I could pursue my own ideas, and set me on my own entrepreneurial journey.

Perceptivei[edit]

Fernandes founded Perceptivei in 2000 following winning the Runner-up position[8] at the Startup@Singapore Business Plan Competition. Perceptivei's technology was one of the Top 4 Business Intelligence and Customer Interaction Application of 2002 by the California-based RealWare Awards.[8][9] He was cited by the Singapore Minister for Information, Communications, and the Arts as a talent who "had made their (his) mark"[10] following his winning of the 32,000 member[11] Singapore Computer Society's Young Professional of the Year Award in 2003.[12]

RecordTV[edit]

RecordTV.com was originally a failed US-based company that provided an illegal cloud-based recording service. The MPAA sued its founder, David Simon for copyright infringement for an estimated US$10 million.[13] Jack Valenti, the CEO of the MPAA called RecordTV.com "one of the most blatant violations of copyright laws"[14] the MPAA's attorneys had ever seen. David Simon initially hired Ira Rothken to defend against the litigation, but eventually gave up, settled[15] through a payment of US$50,000[13] and decided to sell it's assets.[16]

Fernandes, apparently undeterred by the MPAA's pursuit of David Simon purchased the assets of RecordTV.com, but also added in technology that he had invented and patented as "A System and Method for recording television and/or radio programmes via the Internet" in a way that would not violate the rights of copyright owners.[1] Indonesian broadcaster, BeritaSatu interviewed Fernandes at the World Economic Forum in Davos on the topic of the Future of Media and introduced RecordTV as the "world's first legal Internet-based TV Recorder[3]". Among other technical alterations from the original service, the RecordTV.com service was restricted to Singapore users alone and users were able to record only Singapore Free-to-Air content, which was broadcast by Singapore's state-owned broadcaster, MediaCorp. The RecordTV.com website was relaunched in July 2007 and went viral following press coverage. RecordTV faced litigation from MediaCorp as a result of its service, that it eventually won.

Following the victory RecordTV relaunched the service and the service was renamed InstantTV.[17] The InstantTV app for iOS and Android became extremely popular in Singapore. On the Android Play Store, InstantTV went from 10,000 installs on 4 November 2014 to 100,000 installs - a 1000% increase by 3 August 2015,[18] in 7 months.

Blaze[edit]

In 2017, Fernandes launched Blaze, an AI-based conversational news bot[19] that was enhanced through human curation.[20] He has publicly taken the position that messenger bots will replace apps within 5 years.[21] At the World Economic Forum at Davos in 2018 he indicated that he was working on the fake news problem.[22]

RecordTV vs. MediaCorp lawsuit - a case dubbed as a "David vs. Goliath" battle[edit]

Shortly after the launch of RecordTV.com website in Singapore, MediaCorp demanded Fernandes shutdown RecordTV's website or face legal proceedings for Copyright Infringement.[23] Fernandes refused to shutdown his company's website, and instead preemptively sued MediaCorp for groundless threats of copyright infringement proceedings,[23] claimed S$30.5 million in damages[24] and continued to operate it's website. From the onset, the lawsuit captured the imagination of the public and the press covered the case as a David vs. Goliath battle for its audaciousness, no doubt, enhanced by the fact that RecordTV initiated the action. ZDNet broke the news about the case in an article titled "David takes on Goliath in the realm of Copyright".[25] MediaCorp hired Singapore's best known litigator, Davinder Singh the CEO of Drew and Napier to represent them. RecordTV lost the case in the High Court. Fernandes decided to appeal, and Singapore's highest court, the Court of Appeal ruled in RecordTV's favour, awarding costs and damages, and also declaring in its judgment [26] that RecordTV's technology was a significant advancement over traditional DVRs and it was in public interest to allow it to operate.

Impact of the RecordTV victory[edit]

The litigation was declared to be a David vs. Goliath battle [27] that came to "its familiar conclusion", on the front page of the Business Times, the main business newspaper owned by Singapore Press Holdings. Carlos Fernandes was subsequently named[28] as a Young Global Leader at the World Economic Forum.

Public service[edit]

  • From 2005-2017, Fernandes served on the Ministry of Trade and Industry's Pro-Enterprise Panel which is a private-public panel chaired by the Head of Civil Service with mainly business leaders as members, and supported by a network of senior public officers. During his tenure, he served under Head of Civil Service Peter Ho, Peter Ong and Leo Yip.
  • Fernandes was one of the few industry leaders invited[29] to speak to ASEAN IT Ministers at the 3rd ASEAN Telecommunications and Information Technology Ministers Meeting, Singapore. Other speakers included the CEO of Singtel Lee Hsien Yang.
