The deaths of Lawrence and Glenna Shapiro involved the homicide[1] victims Dr. Lawrence Shapiro (aged 79) and his wife of 51 years, Glenna (aged 78) on January 30, 2012, in Paradise Valley, Arizona. The Shapiros' homicide was a shock to the Phoenix metropolitan community,[2] and their deaths and the subsequent police investigations received widespread attention in the national press.[3][4] Prosecutors have speculated about a link between their deaths and that of Bruce Gaudet.[5]

The Shapiros' lives[edit]

Lawrence Jay Shapiro (March 11, 1932 – January 30, 2012) was a medical practitioner who co-founded the Phoenix based Health Services Advisory Group,[6] now one of the United States' leading health-care quality improvement organizations.[7] His wife, Glenna, taught elementary school.[8]

They had lived at this residence in the affluent neighborhood of Paradise Valley since 1971.

The homicides[edit]

Shapiros[edit]

On the morning of Monday January 30, 2012, a black convertible Jaguar[9] was discovered burning in the North area of Phoenix near 7th Street and Union Hills Drive. Phoenix Police learned that the automobile was registered to a Paradise Valley couple some 17 miles away. Subsequently, Paradise Valley Police made an inquiry concerning the vehicle at a home near 40th Street and Camelback Road. A Paradise Valley Police officer arrived to find that the structure was on fire and summoned the fire department. The fire was quickly extinguished, but later two bound and burned bodies were found – those bodies had been burned beyond recognition.

On February 1, 2012, the Paradise Valley Police Department said that an arson and homicide investigation was underway. The following day the Maricopa County Medical Examiner's Office used dental records to confirm the identities of the victims. The last homicide investigated in this city was in 2004.

On July 2, 2012, a final autopsy report declared that both victims died from gunshot wounds to the head. Further, the medical examiner ruled that the manner of death for each of them was homicide.[10]

Gaudet[edit]

On January 26, 2012, 56-year-old Bruce William Gaudet[11] was found dead inside his Phoenix condominium from multiple gunshot wounds.[12] Phoenix Police say a fire at the condominium near 16th Street and Maryland, which happened just a few days before the Shapiros' deaths, could possibly be linked.[13] Bruce Gaudet was affiliated with the cigar industry and had in just the previous seven months moved to Phoenix from Las Vegas.

Police have not revealed any details about how the cases may be connected. However, the arrest of a woman in Yuma County, Arizona was tied to Gaudet's death. Maricela Sanchez was arrested after a high speed chase on January 26, 2012 while driving Gaudet's vehicle, a 2011 Dodge sedan.[14][15] Arizona Department of Public Safety officers say she led them on a 27-mile chase.

Alleged perpetrators[edit]

Arrests[edit]

On February 7–10, 2012, Paradise Valley Police Chief John Bennett announced the arrests of the major suspects. Five women and two men were being held in the custody of the Maricopa County Sheriff's Office.[16]

  • Michael "Sharks"[17] Lee Crane, 31, of Mesa (according to the previous citation) and Tempe (according to a 2012 document)[18]
    • He was charged with and indicted on two counts of first-degree murder; two counts of kidnapping; two counts of armed robbery; one count of burglary; and one count of arson. On October 22, 2009, he was found criminally incompetent to stand trial for a 2009 charge of possessing drug paraphernalia. The court ordred treatment to restore competency. On January 7, 2010, he was found by the court as able to assist counsel with his own defense. Having completed his sentence, Crane was released from prison on December 17, 2010. His record dates as far back as 2001, when he pleaded guilty to marijuana possession.[19][20] He had been recently arrested by Phoenix police on December 7, 2011, on eight felonies including theft, weapon, and drug charges.[21] Multiple news reporters have questioned why Crane was not in custody on these charges. The county attorney has stated that there was insufficient evidence to hold him.[22] Crane is being held on a $3 Million bond.[23] On February 8, 2012, Michael Crane's attorney, Herman Alcantar, requested a mental competency hearing to evaluate if he is competent to stand trial.[24][25] He was also indicted on one count of first-degree murder, one count of kidnapping, two counts related to arson, one count of burglary, one count of armed robbery, and one count of theft of a means of transportation with respect to the homicide of Bruce Gaudet.[26][27] On August 20, 2012, nine new felony charges were added to those already filed (including a charge of attempted second-degree murder).[28][29][30]
  • Shawn "Odo"[31] Eric Nicloy, 29, of Phoenix
    • He was charged with and indicted on one count of trafficking in stolen property and one count of hindering prosecution in the first degree. He was released from prison on January 13, 2012 from a drug charge and was on parole.[32][33] In 2009, Nicloy pleaded guilty to aggravated assault, court documents state.
  • Kelly Ann Steward, 29, of Glendale
    • She was charged with and indicted on one count of theft and one count of trafficking in stolen property. In 2007, Steward pleaded guilty to possessing drug paraphernalia and possession of a forgery device, according to court documents.[34]
  • Brittany Ann Beinhauer, 27, of Tempe
    • She was charged with and indicted on two counts of theft. A search of court records shows Beinhauer pleaded guilty to possessing drug paraphernalia in December.[35][36]
  • Danielle Elaine Rossman, 26, Phoenix
    • She was charged with and indicted on one count of possession of stolen property, one count of trafficking in stolen property and one count of hindering prosecution. Court records show Rossman pleaded guilty to possession of a forgery device in 2006.[37]
  • Katherine Adele Austin, 25
    • She is in custody and indicted on one count of hindering prosecution in the first degree.[38][39][40] Court records show she pleaded guilty to possession of a forgery device in 2005.
  • Maricela "Sole"[41] Otilia Sanchez,[42][43][44] 27, of Phoenix
    • She is in custody and indicted as an accomplice with Crane on one count of first-degree murder, one count of kidnapping, one count of burglary, one count of armed robbery, and one count of theft of a means of transportation with respect to the homicide of Bruce Gaudet.[45][46][47] In 2011, she pleaded guilty to possessing drug paraphernalia. Sanchez is being held on a $1 million bond. On March 8, 2012, she was returned to Phoenix and booked into jail.

As to how or why the crimes occurred, Paradise Valley officials and Maricopa County Attorney Bill Montgomery refused to take questions during the news conference. A judge agreed to seal court records in the case that could provide further details, and members of the local news media are contesting the decision.[48][49]

On Friday March 2, 2012, some court records were unsealed concerning the actual circumstances by which the alleged murders took place. The documents imply that Crane alone was present in the Shapiros' residence.[50] Also, it was noted that Nicloy had later led detectives to three discarded suitcases of the Shapiros' property – this evidence was recovered from the desert near New River, Arizona. Further, these documents reveal that two more suspects are being sought for questioning.[51]

On September 11, 2013, an additional arrest was made.

  • Barry Michael Hassell, II, 29, of Phoenix
    • He was indicted and charged on two counts of murder in the first degree, and one count each of burglary and conspiracy.[52][53][54] He had previously been sentenced to two and one-half years for burglary in the third degree, a class four felony, for misconduct involving weapons, a class four felony, and for and the possession of drug paraphernalia, a class six undesignated felony.[55] He was later released on parole on August 20, 2010. Police records show[56] that on January 11, 2012, Hassell was stopped by police with Crane while driving in Scottsdale, Arizona, in the area of an attempted home burglary.[57] He had been originally arrested and released on US$25,000 bond on May 30, 2012, in connection to the case, for burglary charges. Hassell was charged with being the driver for Michael Crane when the Shapiro burglary and homicides were committed. Hassel was held on a US$1 million bond.

Sanchez jail interview[edit]

On March 12, 2012, Maricela Sanchez gave a public interview from jail to the ABC News Phoenix-affiliate.[58] In that interview, she states that she did not plan or participate in the murder of Gaudet, and that she was high on methamphetamine and brought to Gaudet's residence under the false pretense that the home was Crane's. She states that she heard a gunshot and later waited for Crane in Gaudet's vehicle to drive him away. Further, she states that later at an opportune moment she escaped Crane. Reporters have questioned why she did not just drive away instead of wait for Crane and that upon escaping him why she did not immediately seek police assistance to report a crime.

Sanchez investigation documents released[edit]

May 7, 2012 released police investigator documents detail several events. The first event involves Sanchez's state of mind. She gave investigators an interview in which she claimed that she knew of a doberman pinscher that could speak.[59]

In another event, according to Sanchez, she and her co-conspirator, Crane, knocked on the door to Gaudet's condo and, when no one answered, jumped over a wall in the back.

In a final event, Crane's brother, James Stewart, stated that one night in late January 2012, a woman named "Sole" came to his Mesa apartment and borrowed Stewart's aging Toyota Camry. Witnesses would later tell investigators that they had seen a similar car leaving Gaudet's apartment complex the morning of the fire.

Judicial proceedings[edit]

On June 14, 2012, Michael Lee Crane was determined competent to stand trial.[60] Crane's defence team had sought the court's order to have Crane undergo psychological evaluation by three mental-health experts, but, the results went against the defence.

On June 27, 2012, Crane requested procedural advice in filing for a motion to continue his future court representation as pro se.[61]

At his next scheduled appearance in court on July 18, 2012 Crane demanded that his court-appointed representation be fired and that he be allowed to defend himself. Crane cited anti-government legal theories, claiming that the court had no jurisdiction over him because he is a "sovereign being."[62][63]

"Sovereign citizens" take the position that they are answerable only to common law and are not subject to any statutes or proceedings at the federal, states or municipal levels, or that they do not recognize U.S. currency and that they are "free of any legal constraints."

On October 9, 2012, Judge Warren J. Granville ruled on Crane's motion for self-representation.[64] The court's finding was that

  • "This Court finds that the Defendant's persistent refusal to acknowledge the governing authority for his case and the trial court’s Rule 611 authority to exercise reasonable control over the proceedings would jeopardize the exercise of his rights, would hinder the pursuit of justice, and would disrupt and delay the orderly progress of the case. This Court finds that Defendant’s refusal to accept this Court’s rulings and authority to preside, however politely stated, would disrupt and delay the orderly progress of his case. Finally, even if a defendant has been found competent to waive counsel, the court still has discretion to deny the request for self-representation if the court finds that defendant’s request is not made knowingly. During the Faretta colloquy, Defendant advised the Court on separate occasions and regarding several points that he understood but disagreed with some parts of the Court's advisement. These largely centered on the limits he would have in conducting his investigation and defense while in custody. Because it did not appear that Defendant adequately understood the limits he would be placing upon himself and his ability to adequately mount a defense, this Court cannot find that his request is "knowingly" made. Based upon the totality of the circumstances, IT IS ORDERED denying Defendant's request for self-representation."[65]

On June 4, 2013,[66] the court ordered that Crane be held as non-bondable, subject to a Simpson hearing.[67]

On July 17, 2013, the state was granted their motion to subsequently depose three of the co-defendants, Nicloy, Sanchez, and Rossman. The court advised Crane that he might witness such exchanges of testamony, but that, he would be barred from either oral statements to or direct interrogation of said witnesses. Further, the court advised Crane that all activity in such depositions would be recorded and available to jurors at trial.[68]

On November 1, 2013, Hassell's bond was lowered to US$25 thousand cash.[69]

On January 10, 2014, the Superior Court for Maricopa County ruled that other (non-capital) charges against Crane would be addressed in a separate trial.[70] The other charges stem from both an alleged 2011 burglary and a February 2012 burglary. Prosecutors allege that in the 2012 incident Crane was interrupted while burglarizing a Phoenix home and fired shots at one of the homeowners. The separate trial will cover charges which include attempted second-degree murder, burglary, theft, misconduct with weapons, armed robbery, and aggravated assault.

As of March 26, 2014, only these defendants had not accepted any plea agreements, and thus, they were still scheduled for their trial dates:

  • Michael Lee Crane
    • March 28, 2014 – is his next scheduled court date.[71] Assuming no plea deal is reached, his trial is set to begin on July 29, 2014.[72]
  • Barry Michael Hassell, II
    • May 22, 2014 – is his next scheduled court date.[73] On March 20, 2014, his trial, which was set to begin on April 3, 2014, was removed from schedule.[74]

As of March 26, 2014, this defendant had accepted only some plea agreements, and thus, she was still scheduled for her trial date:

  • Maricela Otilia Sanchez
    • April 1, 2014 – is her next scheduled court date.[75]

Convictions[edit]

  • Maricela Otilia Sanchez
    • February 10, 2012 – pleaded guilty to drug paraphernalia violation. Under her plea, she will formally receive a sentence when her other complex case charges are settled. The next hearing date with respect to only these charges is April 1, 2014.
    • January 17, 2013 – pleaded guilty to the theft of a means of transportation. Under her class three felony plea,[76] she received a sentence of eight and three-fourths years. She admitted to the theft of Gaudet's vehicle.
  • Danielle Elaine Rossman
    • June 8, 2012 – pleaded guilty to hindering prosecution in the first degree – involving either terrorism or murder. Under her class three felony plea,[77] she will formally receive probation at her next hearing on April 1, 2014.[78] She admitted to disposing of the suitcases instead of contacting police after she realized they belonged to the murder victims. According to her plea arrangement, the two additional counts of one count of possession of stolen property and one count of trafficking in stolen property were dropped. On January 31, 2014, Rossman's release terms were modified such that she would be allowed to remove and discontinue her electronic location-monitoring device.[79]
  • Kelly Ann Steward
    • June 12, 2012 – pleaded guilty to trafficking in stolen property in the second degree. Under her class three felony plea,[80] she will formally receive a sentence at her next hearing on April 2, 2014. According to her plea arrangement, the one additional count of theft was dropped.
  • Brittany Ann Beinhauer
    • June 25, 2012 – pleaded guilty to theft of a credit card or obtaining a credit card by fraudulent means, with one prior felony conviction. Under her class five felony plea,[81] she received a sentence of 2.25 years on July 31, 2012.[82][83][84] She admitted to theft of a credit card. On July 24, 2013, she was released from prison on parole.
  • Katherine Adele Austin
    • June 26, 2012 – pleaded guilty to hindering prosecution in the first degree – involving either terrorism or murder. Under her class three felony plea,[85] she received a sentence of 3 years on July 31, 2012.[86][87] She admitted to hiding evidence by taking suitcases of the Shapiros' belongings and discarding them in the desert. Her current earliest release date is June 20, 2014.
  • Shawn Eric Nicloy
    • August 23, 2012 – pleaded guilty to trafficking in stolen property in the second degree, with one prior felony conviction. Under his class three felony plea,[88] he will formally receive a sentence at his next hearing on April 1, 2014.[89][90] According to his plea arrangement, the one additional count of hindering prosecution was dropped.
    • September 7, 2012 – a previous criminal history earned him incarceration, with respect to a prior conviction for aggravated assault committed on June 4, 2009, when his probation was revoked from this other class three felony plea, and he received a sentence of 5 years.[91][92] His current earliest release date, assuming his other conviction runs concurrent, is March 24, 2016.
