The Donetsk status referendum is a proposed referendum on the status of Donetsk Region said to be held on 11 May 2014, by the Donetsk People's Republic,[1] which self-declared its independence from being a subdivision of Ukraine. The referendum will ask the people of Donetsk whether they seek independence from Ukraine.
Background[edit]
The move also follows a similar measure during the successful Crimean status referendum, 2014 that led, initially, to independence and then annexation into the Russia.
Events leading up to the referendum[edit]
After the Donetsk People's Republic was declared, Ukrainian acting President Olexander Turchynov said that this, along with protests in other cities, were allegedly evidence of a "second stage" of Russian operations "playing out the Crimean scenario."[2] While several municipal councils were being held by armed separatists and a Ukrainian "anti-terrorist operation" was being carried out against the areas, the Donetsk People's Republic announced that it would carry out the referendum on 11 May on secession and possibly seeking to join Russia. The Ukranian-recognised local administration's officials issued a statement on 16 April saying that it had met representatives from the People's Republic of Donetsk to seek negotiation to end the violence that had left af least one person dead and about 24 others injured at the time.[3] In early April, the deputy of the People's Republic of Donestsk, Miroslav Rudenko, said the referendum was "to legitimise the declaration of the Donetsk republic [asking for] "support [for] the sovereignty of Donetsk." The administration had also declared illegitimate the regime that had "violently usurped" the government following Euromaidan protests and that it would fire all the officials it had appointed in Donetsk. Similar referenda would also be held in Lugansk and Kharkiv.[4]
Further, despite an agreement in Geneva between the United States, European Union, Russia and Ukraine to demilitarise the conflict, the leaders of Donetsk rejected it in saying that Russian Foreign Minister Sergey Lavrov did not represent them. Instead they said that they would only leave the administration facilities after the referendum.[5]
Organisation[edit]
A central election committee would be set up Donetsk to organize the referendum.[6]
Legal aspects[edit]
According to article 73 of the 1996 Constitution of Ukraine[7] and article 3 of the 2012 Ukrainian law "On all-Ukrainian referenda," territorial changes can only be approved via a referendum where all the citizens of Ukraine are allowed to vote, including those that do not reside the area.[8] During Crimea's referundum, the Central Election Commission of Ukraine also stated that there are no judicial possibilities, according to the legislation of Ukraine, to initiate such changes.[9]

The first will supposedly ask: 'Do you agree with creating an independent Donetsk republic?' And the second will ask: 'Which state should the Donetsk republic be part of – Ukraine or Russia?'
