Doug Bania is an American business executive and expert witness.[1] He is the founding principal of Nevium Intellectual Property Consultants.[2]
Career
Bania founded Nevium Intellectual Property Consultants in San Diego, California in 2012. He is a Certified Licensing Professional (CLP) and is a past committee member (2016–2019) for the International Trademark Association (INTA) Internet Committee and the ICANN Compliance and Domain Name Industry Subcommittee. He serves as a current member of the INTA Right of Publicity Committee and the Influencers Subcommittee. He has been the named expert for over 125 cases, deposed 29 times, and has provided trial testimony 10 times.[3][4][not in citation given]
He holds a Bachelor of Arts in Cinema from San Francisco State University and a master’s in Television, Film, and New Media Production from San Diego State University.[5]
Bania has been published in scholarly journals including the Journal of Intellectual Property Law & Practice,[6] International Journal of Law and Public Administration,[7] and other publications such as The World Trademark Review[8] along with book chapters in Calculating Economic Damages in Intellectual Property Infringement Cases (2016)[9] and The Comprehensive Guide to Economic Damages (2021) both published by Business Valuation Resources (BVR).[10]
"Blurred Lines" testimony
In 2015, Bania testified in the trial between Marvin Gaye’s family and those associated with producing the 2013 hit, "Blurred Lines," written by Pharrell Williams and performed by Robin Thicke.[11][12] He testified that his analysis showed that much of the song's lucrative success also had to do with the video.[13]
Depp v. Heard testimony
In 2022, Bania was the social media and internet analytics expert in the Johnny Depp vs. Amber Heard defamation trial.[14] He testified about the impact of Heard's allegations of domestic abuse against Depp as made in her 2016 domestic violence restraining order and her op-ed in the Washington Post on Depp's career, reputation, and public image in December 2018.[15]
Bania used Google Trends and historical Google search results to show that the public's perception of Depp changed for the worse after the Washington Post op-ed.[16][unreliable source?] He refuted Heard's witness Ron Schnell who testified as an expert in the field of statistical and forensic analysis of social media.[17][18]
