The Ateneo De Manila Loyola Schools Student Council (Filipino: Sanggunian ng mga Mag-aaral ng mga Paaralang Loyola ng Ateneo de Manila) is the sole autonomus school council of the Ateneo de Manila University Loyola Schools.[1][2] It is governed under a presidential constitutional republic where the President functions as both the head of government and the head of state of the student body.[3] The student government is composed of three distinct and autonomous arms: legislative, executive and judicial, whose powers are vested by the Constitution of the Undergraduate Students of the Ateneo de Manila Loyola Schools in the Central Assembly, the president and the Student Judicial Court, respectively. The constitution establishes the Commission on Audit, the Commission on Elections, and the Office of the Ombudsman as well.[3]

Legislative arm[edit]

The Sanggunian Central Assembly, under Article VII of the Constitution, is the legislative branch of the student government. It is unicameral.

Makeup of the Central Assembly[edit]

As defined in Article VII, the Central Assembly consists of the Vice President, School Representatives, Sectoral Representatives, the COA Representative, the ARSA Representative, and appointed Committee Heads from the Course Representatives. The Central Assembly is chaired by the Vice President. S/he cannot vote, except to break ties. The Central Assembly are also required to meet as often as necessary to discharge their functions.

Powers of the Central Assembly[edit]

The constitution grants numerous powers to the Central Assembly. Enumerated in Article VII, Section 2, these include powers to review, approve and/or reject decisions of Creation of Committees and Projects made by any member of the Central Assembly; review, approve and/or reject submissions of Resolutions, Policies, Programs, and Stands made by any member of the Central Assembly; try, investigate and impeach magistrates of the Student Judicial Court; and override a presidential veto against a decision made in university or sectoral-level.

Executive arm[edit]

The executive power in the student government is vested in the president of the Sanggunian, although power is often delegated to the Cabinet members and other officials.

President[edit]

The executive branch, under Article IV of the Constitution, consists of the president and those to whom the president's powers are delegated. The president is both the head of state and government, as well the official spokesperson of the Sanggunian. The president presides over the executive branch of the student government. The president may create and dissolve, departments, committees, projects, and task forces, at sole discretion.

The president may sign legislation passed by the Central Assembly into law or may veto it, preventing it from becoming law unless majority (50% + 1) of the Central Assembly vote to override the veto. The president may not dissolve Congress or call special elections, but enact executive orders.

Vice president[edit]

The vice president is the second-highest official in rank of the student government. The vice president's duties and powers are established in the legislative branch of the student government under Article VIII, Section 1, Subsection 1, Clause 1 and 2 as the president of the Central Assembly; this means that he or she is the designated presiding officer of the Central Assembly. In that capacity, the vice president has the authority (ex officio, for they are not an elected member of the Senate) to cast a tie-breaking vote. As first in the presidential line of succession, the vice president's duties and powers move to the executive branch when becoming president upon the death, unfortunate disability, resignation, impeachment or disposition of the president.

Cabinet, executive departments[edit]

The daily enforcement and administration of laws and policies is in the hands of the various executive departments, created by the president to deal with specific areas of in-school and inter-school affairs. The heads of the 6 departments, chosen by the president, form a council of advisers generally known as the president's "Cabinet". Once confirmed, these "cabinet officers" serve at the pleasure of the president.

Article VIII Section 1 establishes the Student Judicial Court is the Official Judicial Arm of the Sanggunian. The Student Judicial Court, which has a Chief Magistrate as its head and 6 other Magistrates, occupies the judiciary. According to Article VIII, Section 2, Magistrates of the Student Judicial Court are to be appointed into office by all outgoing magistrates, not seeking reappointment.

Powers of the Student Judicial Court[edit]

The Student Judicial Court is granted numerous powers in Article VIII Section 1, Subsection 2, namely; sit en banc, hear, try, and resolve complaints involving matters of constitutionality, legality, and jurisdiction over acts, policies, and resolutions committed by the Sanggunian; adopt its own Code of Internal Procedures and Rules of Court; determine its own necessary structures and procedures concurrent with this Constitution; appoint Court Officers necessary to operate the different offices of the Student Judicial Court; work together with the Office of the Ombudsman and the Commission on Audit as necessary to render the accountability of the Sanggunian, its units and its members; review, approve and/or reject decisions of appointments made by any members of the Sanggunian; and summon and order investigations, suspensions, and impeachments/ recalls of Sanggunian Officials.

Commission on Elections (COMELEC)[edit]

As defined in Article XI of the Constitution, the Commission on Elections is the official electoral body of the school government. The Commission on Elections consists of five Commissioners and one Chief Commissioner. According to Article XI, Section 2, Subsection 3, Commissioners of the Commission on Elections are to be appointed into office by all outgoing Commissioners, not seeking reappointment.

Powers of the Commission on Elections[edit]

The Commission on Elections presides over election of Sanggunian officers and other elected positions. The constitution grants the commission whole power over the process of election, through an Electoral Code. The electoral code lines all the procedures for the election of Sanggunian officers and other elected positions. The current electoral code is the 2018 Sanggunian ng mga Mag-aaral ng mga Paaralang Loyola ng Ateneo de Manila Electoral Code.

Commission on Audit (COA)[edit]

Overview of the Commission on Audit[edit]

Article X of the Constitution establishes the Commission on Audit as the official auditing arm of the school government. The Commission on Audit is occupied by one Commissioner and at least six auditors. According to Article X, Section 2, Subsection 3, Commissioners of the Commission on Audit are to be appointed into office by all outgoing Magistrates, not seeking reappointment. The commissioner is the presides over all proceedings of the Commission on Audit and; is the chief executive officer and spokesperson of the Commission on Audit.

Powers of the Commission on Audit[edit]

The Commission on Audit is granted numerous powers in Article X, Section 1, Subsection 3 namely; adopt its own Code of Internal Procedures and determine its own necessary offices and procedures concurrent with this Constitution; be charged with ensuring accountability in the management of funds, revenues, expenditures, and disbursements of every Sanggunian unit; file a petition or complaint to the Student Judicial Court against any Sanggunian official accused of misappropriating funds; and publicize and submit semestral reports to the President, Chief Magistrate, and Ombudsman.

As of the 2019 constitution, the Commission is also required to create an Audit Manual under Article X, Section 4.

Office of the Ombudsman[edit]

Overview of the Office of the Ombudsman[edit]

As defined in Article IX of the Constitution, the Office of the Ombudsman is the official investigative arm of the school government. The Ombudsman and the Prosecutors of the Office shall be appointed by all outgoing magistrates of the Student Judicial Court, not seeking reappointment, being that all members of Office the Ombudsman are not occupying an appointed or elected positions in any Sanggunian unit or instrumentality, or member of any political party or coalition.

Powers of the Office of the Ombudsman[edit]

The Office of the Ombudsman, as the investigative arm, facilitates the check and balance of the Sanggunian and ensure accountability from its members and offices. It can investigate at its own discretion or on complaint, request official documents and/or testimony from members of the Sanggunian, and initiate legal action for the recovery of ill-gotten wealth and recommend removal, suspension, censure, and/or prosecution when acts or omission appears to be unconstitutional, illegal, unjust, inefficient, or outside respondent body's jurisdiction.
