NSTEP - is the National Service and Tracking of Electronic Process[2]. It works on the basis of the Data available in Case Information System (in short the CIS). CIS is the backbone of Indian Judiciary after the Hon’ble E-Committee, Supreme Court of India had decided to computerize all District and Taluka Courts in India. NSTEP is a mechanism inbuilt in CIS, for serving the Electronic Process and Tracking the same. By the introduction of NSTEP, the Electronic Processes can be served on the Parties and the Acknowledgment for the service of the Process can be received by the Courts within a short span of time.

There are nearly 14,000 District and Taluka Courts in India. The Hon’ble E-Committee, Supreme Court of India, by its Policy had decided to enlarge the Citizen Centric Services through e-Court Projects. Accordingly, the Hon’ble Computer Committee of the Hon’ble Madras High Court had purchased and distributed Smart Phones to the Process Servers with all latest Technologies for NSTEP Service.[3]

Inauguration of NSTEP in Tamil Nadu[5]

On 17.09.2020, the Virtual Inauguration of 1. NSTEP (National Service and Tracking of Electronic Process), 2. e-SEVA Center at Yercaud, 3. E-Court Services (through e-SEVA Center, Government of Tamil Nadu), 4. Biometric Attendance for all courts in District Judiciary and 5. e-Way Finder at the Principal Seat, Madras High Court, was made, by the Hon'ble Dr. Justice D.Y. CHANDRACHUD, Judge, Supreme Court of India and Chairman, E-Committee, Supreme Court of India, in the august presence of The Hon’ble Mr. Justice. Amreswar Pratap Sahi, Chief Justice of Madras High Court and The Hon’ble Thiru. Justice. T.S. Sivagnanam, Chairman of the Computer Committee and Hon’ble Members of Computer Committee Hon’ble Tmt. Justice. Pushpa Sathyanarayana, Hon’ble Thiru. Justice. M.Sundar, Hon’ble . Thiru. Justice. A.D. Jegadish Chandira, Hon’ble.Thiru. Justice. C.Saravanan.

Tracking and Monitoring by Judges

In all Civil Cases, the Presiding Judge of the Court orders for the Issue of Summons or Notice to the Parties concerned. In all Criminal Cases, the Presiding Judge of the Court orders for the Issue of Summons or Warrants to the Parties concerned. In all Plead Guilty Cases, the Presiding Judge of the Court orders for the Issue of Summons to the Parties. The Presiding Judge of the Court Tracks and Monitors the service of the Process. Depending upon the service of Process, the Presiding Judge of the Court proceed to the next stage of the Case.

The System Analysts / System Officers

The System Analysts / System Officers of the District Courts play a vital role in NSTEP. The System Analysts / System Officers of the District Courts are Configuring the Integration of CIS and NSTEP. In CIS, Configuration Tab is maintained by System Analysts / System Officers.

For Configuration and Integration, the System Analysts have to open Configuration Tab in CIS. Then they have to open the Sub Tab Configuration > Configure Integration. Then they have to select NSTEP Tab. Then they have to enter the URL as “ http://nstep.ecourts.gov.in/nstep”. Then they have to Click “Submit” Button and “Next” Button. By this Configuration, CIS will search for the NSTEP Portal for Integration. After this Integration only NSTEP will function in CIS.

Data Entry Staffs

All Data are entered in CIS by concerned staffs nominated by the Presiding Judge. Depending upon the strength of Staffs, workload and Open Court work, the Data entry staff may differ from time to time. The Data entry Staff may be a Typist, or a Stenographer, or the Bench Clerk. They work on Coordination among themselves. All Data should be entered in full in CIS. Then only, the expected result will come out. It all depends on the Data entry Staffs. The Data Entry Staffs are omitting some of the Fields in CIS. This Omissions are happening while numbering a Case or Caveat, emergently. This Omission will reflect in the result. For example, while Numbering a Criminal Case in which 20 Accused are cited, the Data Entry Staff usually enters the Name and Address of the 1st Accused and omits the Name and Addresses of the other Accused. After numbering the case, they have to complete the data entry process, in CIS. But, due to heavy work, and scarcity of Staffs, the Data entry staffs are postponing the process of completing the Data Entry. At last, they forget to complete the Data Entry. As a result, the Court may not be able to frame Charges against the Accused in CIS using the Templates. Likewise, the Generation of Summons, or Warrant can not be done in CIS. In a Civil Case, the Names and Addresses of all the Defendants are necessary. If some of the Names and Addresses are omitted in Data Entry, then Summons or Notice can not be Generated in CIS. This will affect the Process in NSTEP. The Success of NTEP is based on the Data Entry in CIS. So, while Numbering the Case, all Data should be entered by the Data Entry Staffs, without any omission.

Civil Process Generation

Inside Court Proceedings > Civil / Criminal Processes, The Data Entry Staffs should select “Process Generation”. Then they have to select the Case Type as “Civil” or “Criminal” or “Plead Guilty”. For Generating the Civil Case Processes, the Data Entry Staffs should select “Civil”, Then they should select the “Case Number” ( From the Drop Down List). Then they should select the “Process” ( From the Drop Down List). Then they should enter the details in “Select Addressee” Tab, “ Addressee Details” Tab, and “Generate Draft” Tab. Inside the “Select Addressee” Tab, The Data Entry Staffs should select “Fee Type” either as “Paid” or “Free / on Court Motion”, Then they should enter the “Process Fee”, Then they should select “Addressee Type” ( From the List), Then they should select “Addressee Name” (From the List) Note: – Here the Name of the Party will not appear, if the Data was not entered in CIS when numbering the Case. Then the Data Entry Staffs should enter the “Foot Note”, “Nature” (From the List) click “Save” Button. Inside the “Addressee Details” Tab, The Data Entry Staffs should select “ Addressee Name”, Then they should select “Relation”, “Address”,“Main” or “Alternate Address”, “State”, “District”, “Taluka”, “Village”,“Police Station”, “PIN Code”Mobile Number”, “Remarks”, “E-Mail”, and Click “Save” Button. Inside the “Generate Draft” Tab, The Data Entry Staffs should verify the details. and Click “Generate Draft” Button. Now the Draft of Civil Process is ready.

Criminal Processes Generation

For Generating the Criminal Case Processes, the Data Entry Staffs should select “Criminal”, then they should select the “Case Number” ( From the Drop Down List), then they should select the “Process” ( From the Drop Down List), then they should select “State”, “District”, “Police Station”, “FIR Number”, “Year”, Then the Data Entry Staffs should enter the details in “Select Addressee” Tab, “Addressee Details” Tab, “Party Concerned” Tab, “Select Party Details” Tab, and “Generate Draft” Tab. Inside the “Select Addressee” Tab, The Data Entry Staffs should select “Fee Type” either as “Paid” or “Free / on Court Motion”, then they should enter the “Process Fee”, “Addressee Type” ( From the List), “Addressee Name” (From the List) Note: – Here the Name of the Party will not appear, if the Data was not entered in CIS when numbering the Case. Then the Data Entry Staffs should enter the “Foot Note”, “Nature” (From the List) and Click “Save” Button. Note: “Addressee Name” in Criminal Process is the Police Officer. It is not the Accused Name. Accused Name is noted as “Party Concerned”. Inside the “Party Concerned” Tab, the Data Entry Staffs should select “Party Type”( From the List),“Party Name” (From the List). Note: – Here the Name of the Party will not be appear, if the Data was not entered in CIS when numbering the Case. Then the Data Entry Staffs should Click “Save” Button. Note: “Addressee Name” in Criminal Process is the Police Officer. It is not the Accused Name. Accused Name is noted as “Party Concerned”. Inside the “Select Party Details” Tab, The Data Entry Staffs should select “Party Name”, “Relation”, “Address”, “Main” or “Alternate Address”,“State”, “District”, “Taluka”, “Village”, “Police Station”, “PIN Code”, “Mobile Number”, “Remarks”, “E-Mail” and Click “Save” Button. Inside the “Generate Draft” Tab, The Data Entry Staffs should verify the details and Click “Generate Draft” Button. Now the Draft of the Criminal Process is ready.

Civil Process Acknowledgement / Print

To take a Print or for Acknowledgement, The Data Entry Staffs should select “Civil”, “From Date” and “To Date”, “Go” then Click “Print” for getting a copy printed or for getting a copy with Acknowledgement tick the box and Click Acknowledgment. Now the Printed Copy of the Civil Process is ready with Acknowledgment.

Criminal Process Acknowledgement / Print

The Data Entry Staffs should select “Criminal”, then “From Date” and “To Date” and Click “Go” Button, then Click “Print” for getting a copy printed or for getting a copy with Acknowledgement tick the box and Click Acknowledgment. Now the Printed Copy of the Civil Process is ready with Acknowledgment.

Publish Civil Process

For Publishing Civil Process, the Data Entry Staffs should select “Civil”, then the Data Entry Staffs should select “From Date” and “To Date”, then Click “Go” Button and Click “Publish” Button. Now the Civil Process is Published Successfully.

Publish Criminal Process

For Publishing Criminal Process, the Data Entry Staffs should select “Criminal”, then the Data Entry Staffs should select “From Date” and “To Date”, then Click “Go” Button and Click “Publish” Button. Now the Criminal Process is Published Successfully.

Process Status

To get the Status of the Civil or Criminal Process, the Data Entry Staffs should select Process Status. Then the Data Entry Staffs should select “All” or “Pending” or “Served” or “Unserved” to view the Status of Process under each category. Then the Data Entry Staffs should select “From Date” and “To Date” and Click “Go” Button. Now the Processes are available for viewing their Stage.

Upload Civil Process

For uploading Civil Processes, the Data Entry Staffs should select “Civil”, “Case Number”, “Process”, “Addressee Type”, “Addressee Name”, “Relation”, “Address”, “Main” or “Alternate Address”, “State”, “District”, “Taluka”, “Village”, “Police Station”, “PIN Code”, “Mobile Number”, “Remarks”, “E-Mail”, “Browse” Button. Then the Data Entry Staffs should select the File from the location inside the Computer. Then the Data Entry Staffs should select “Preview” for verification of the Process and Click “Submit” Button. Now the Civil Process is uploaded successfully.

Upload Criminal Process

For uploading Criminal Processes, the Data Entry Staffs should select “Criminal”, “Case Number”, “Process”, “Addressee Type”, “Addressee Name”, “Relation”, “Address”, “Main” or “Alternate Address”, “State”, “District”, “Taluka”, “Village”, “Police Station”, “PIN Code”, “Mobile Number”, “Remarks”, “E-Mail”, and Click “Browse” Button. Then the Data Entry Staffs should select the File from the location inside the Computer. Then the Data Entry Staffs should select “Preview” for verification of the Process and Click “Submit” Button. Now the Criminal Process is uploaded successfully.

Copy Previous Process

If the Process was already Published and the same Process is needed again for subsequent date, then the Data Entry Staff need not generate the Process again. Instead, the same Process can be copied again by selecting Copy Previous Process. Now the Data Entry Staffs should select “Civil” or “Criminal”, “Case Number”, “Published Process” and Click “Generate Draft”. Now the Copy of the Previous Process is ready.

Nazar Admin Users

Nazar Admin Users are created with separate Usernames and Passwords, in NSTEP Portal. The Nazar Admins have to visit the NSTEP Portal frequently, to verify whether any process is pending for service. If there are Processes waiting to be served within the same District, then the Nazar Admin can allot the Process to the available Process servers within his jurisdiction. If there are Processes to be served outside his jurisdiction but within the State, then the Nazar Admin can forward the Process to Concerned District Nazar Admin for service. If there are Processes to be served outside the State, then the Nazar Admin can forward the Process to Concerned District Nazar Admin of the particular State, for service. If any Process is received from other Districts or Other States, then the Nazar Admin should allocate the Process to the Process servers for service.

Within NSTEP Portal

To enter into the NSTEP Portal, through Internet, the Nazar Admins should search the website of NSTEP. The website for NSTEP is: “http://nstep.ecourts.gov.in/nstep”. Once, the Nazar Admins found the NSTEP website, then they have to enter their Username and Password and Click “Submit” Button. Now the Nazar Admins are inside the NSTEP Portal. After that the Nazar Admins can see the Dashboard. On the top of the Dashboard, the User Name and the District will be displayed. Below that, the Nazar Admin has to select either “Pending Service”, or “Served”, or “Service Failed”, In “Pending Service” Option, the Nazar Admin can see the Details of Process which are yet to be served. In “Served” Option, the Nazar Admin can see the Details of Served Processes. In “Service Failed” Option, the Nazar Admin can see the Details of Processes which are not able to be served. After selecting “Pending Service”, on the Menu Bar the Nazar Admin can see “User Management” and “Process Management”. In User Management, the Nazar Admin can see Change Password Option. If the Nazar Admin wants to change his/her password, then it can be changed here. In Process Management, the Nazar Admin can see A). Consume Data, B). Process Allocation, C). Process Deallocation, D). Bailiff Process Transfer, E). Process Delivery, F). Process Status and G). Consume Data Previous Year. In Consume Data, the Nazar Admin should select the “Court Establishment” and the “Court”, with the “Tick Mark”, then the Nazar Admin should Click “Pull” Button. Now the Processes are pulled, successfully. In Process Allocation, the Nazar Admin should select any one of the Options of “Civil Process” or “Criminal Process”. then, “Bailiff” or “Other Process Messenger” or “Within State” or “Outside State”, “From Date” and “To Date”, then Click “Go” Button. Now the Nazar Admin can see the Processes pending for service.

For Process Allocation, the Nazar Admin should select the Name of the Bailiff (Process Server). Then, the Nazar Admin should Click the “Tag” Button and Click “Submit” Button. Now the Process is allocated to the Bailiff (Process Server), successfully. The allocated Bailiff (Process Server) can see the Process in his NSTEP Mobile Phone provided to him/her by the Hon’ble High Court. If the Process is to be served Within the State, then the Nazar Admin should select “Within State”,“District” “Establishment” and Click the “Tag” Button. Then the Nazar Admin should Click “Submit” Button. Now the Process is allocated “Within State”, successfully. If the Process is to be served “Outside” the State, then the Nazar Admin should select “Outside State” “State”, “District” “Establishment”. And Click the “Tag” Button. Then the Nazar Admin should Click “Submit” Button. Now the Process is allocated “Outside State”, successfully. In Process Deallocation, the Nazar Admin can see the Process allocated to each Bailiff (Process Server). If the Nazar wants to Allocate the Process to some other Bailiff, then the Nazar Admin should select the Name of the Bailiff (Process Server) and Click “Deallocate”. Now the Process is Deallocated from the previously allocated Bailiff (Process Server) and it is available for fresh allocation. Now the Nazar Admin can allocate the Process to some other Bailiff (Process Server) as per Process Allocation. This Process Deallocation can be done only before the Process was served. In Bailiff Process Transfer, the Nazar Admin can transfer the Process to some other Bailiff (Process Server). If the Nazar wants to Allocate the Process to some other Bailiff (Process Server), then the Nazar Admin should select the Name of the Bailiff from whom the Process to be Transferred and to the Bailiff (Process Server) to whom the Process is to be allocated. Now the Nazar Admin can allocate the Process to some other Bailiff (Process Server) without going for Process Allocation. This Bailiff Process Transfer can be done only before the Process was served. In Process Delivery, the Nazar Admin can see the Delivered Processes by each Bailiff. By selecting the Name of the Bailiff, the Nazar Admin can monitor the work done by the particular Bailiff. In Process Status, the Nazar Admin can see the Details of the Status of the Process. The Nazar Admin can see all the Processes with their current Status. The Nazar Admin can also see the reason for which the Process was not able to be served. In Consume Data Previous Year, the Nazar Admin can consume the Processes of the Previous Years. The Nazar Admin can consume the Previous Year Data and the same can be utilized for Allocation if it was not served earlier. This will reduce the Type work again and again.

The Process Servers (Amins / Senior Bailiffs / Junior Bailiffs)

The Hon’ble Computer Committee of the Hon’ble Madras High Court had purchased Smart Phones for the Bailiffs (Process Server) for the purpose of serving Process by following NSTEP Application (App) Facility in the Smart Phones. This Speedy Service of Process is yet another Mile Stone in the Success history of the Hon’ble Computer Committee of the Hon’ble Madras High Court. With the help of the Smart Phones, the Bailiffs (Process Server) are able to Serve the Process, able to take Photo of the Parties, able to get the Signature of the Parties electronically, and able to capture the Location with the help of GPRS facility provided in the Smart Phones. The Bailiffs (Process Server) should switch on their Smart Phones. The Bailiffs (Process Server) should Click the NSTEP App. Now the NSTEP App opens. Then the Bailiffs (Process Server) should enter their Mobile Number. Then the Bailiffs (Process Server) should enter the Password provided to them. Then the Bailiffs (Process Server) should Click the View Process Button. After verifying the Name, Address in the Process, the Bailiff (Process Server) should proceed to the place where he / she has to serve the Process.

At the place of service, The Bailiff (Process Server) should verify the Identity of the party and hand over the hard copy of the Process. While delivering the hard copy of the Process, the Bailiff (Process Server) should take the Photo of the Party who received the Process. Then the Bailiff (Process Server) should get the Signature of the Party by using the touch screen facility available in the Smart Phone. By this Facility, the Party can put his/ her signature on the Screen of the Smart Phone. Then the Bailiff (Process Server) should Click the “Tick” Button. Then the Bailiff (Process Server) should Click “Location” Button. By this Option, the Smart Phone captures the Latitude and the Longitude of the Area in which the Process was served by using GPRS Facility Provided in the Smart Phone. Then the Bailiff (Process Server) should select the “Served” or “Unserved” Option. If the Process was served, then the Bailiff should select the “Served” Option. Then the Bailiff should select the description of the Service by clicking the drop down menu. If the Process was not served, then the Bailiff should select the “Unserved” Option. Then the Bailiff should select the reason for Non-service of the Process by clicking the drop down menu. Then the Bailiff (Process Server) should Click “Upload” Button. Once, the Process was served the same will reflect in CIS. Now, the Court which send the Process for service can see the Status of the Process in CIS. It is very often said that the cases are pending for long time for want of Service of Processes. Hitherto, the Scenario will change by the effort taken by the Hon’ble Computer Committee of the Hon’ble Madras High Court.
