AirAdvisor is a Boston, Massachusetts-based air transport claims management and EU passenger rights enforcement organization.[1][2][3]

Overview[edit]

AirAdvisor is an intermediary company that makes claims on behalf of air passengers against air transport companies due to delayed, canceled flights or the refusal of passengers to board a plane due to overcrowding.[4][5] The company submits claims to airlines in accordance with EU Regulation 261/2004.[6] If the compensation is successfully recovered, the company applies a fee of 30% calculated on the recovered compensation, and it goes up to 50% if legal action has to be undertaken against an airline.[7]

The company uses a "totally remote" methodology to provide services from places like the United States, Ukraine, Poland, Germany, and Canada. As a legal service corporation, the company negotiates payments from airlines on behalf of private, public, and corporate clients like travel agencies, tour operators, booking services, and concierge services. Since its launch in 2017, AirAdvisor has assisted more than 100,000 clients from 56 nations.[8]

Founding[edit]

Anton Radchenko created AirAdvisor in May 2017 with headquarters in Boston, Massachusetts. The conception of AirAdvisor was motivated by Radchenko's personal experience. When Lufthansa Airlines delayed Radchenko's boarding on a connecting aircraft from Frankfurt to Dubai, he could not receive compensation despite being a lawyer. Radchenko conceived of integrating AirAdvisor as a simple and effective internet-based solution for assisting tourists in claiming reimbursement from airlines.[9][10][11]

Online mechanism[edit]

AirAdvisor hosts an online mechanism to assist passengers in claiming compensation from airline companies. The compensation may be requested within three years of the incident date, up to a maximum of EUR 600 ($700). Below are the steps to seek AirAdvisor’s legal services:

  • Through the online system, AirAdvisor first evaluates whether the client is eligible for compensation. The system's online flight delay compensation calculator evaluates each case automatically and free of charge.
  • AirAdvisor gathers data from many databases using artificial intelligence-enabled methods to determine what transpired when a flight was delayed or canceled to support claims against airlines.
  • If an airline rejects a claim, but AirAdvisor believes it is valid, AirAdvisor will pay for the claim to proceed to court in the relevant jurisdiction for proper collection.
  • On successful recovery of compensation, AirAdvisor charges a fee of 30% on the amount of compensation received. AirAdvisor charges 50% of recovered compensation as a fee in cases involving a lawyer.

EC Regulation 261 guidelines[edit]

The EU regulation 261 specifies the norms and procedures for monetary compensations and assistance to passengers in the event of flight disruptions. The following are the general guidelines for delayed, canceled, missed, and denied boarding:

  • When a flight is canceled within 14 days of departure, monetary compensation may be provided.
  • If passengers reach their destination with a delay of more than three hours, they can file a claim for a late flight.
  • If all flights are included in a single booking, EC261 treats the booking as a whole. This means that compensation may be paid if one of the connecting flights is delayed or canceled.
  • If the airline refuses to board, passengers may file a claim for overbooking compensation.
