Muwema & Mugerwa Advocates & Solicitors commonly known as Muwema & Mugerwa and simply referred to as M&M Advocates is a prominent[3] Ugandan law firm headquartered in Kampala,[2] the Capital City of Uganda. It is a private legal practice firm founded in 1999. The firm is a Commercial Law practice in Uganda and beyond[4] that is renowned for having a keen interest in Public Interest Litigation (PIL) cases.[5][6][7]

The firm’s first major breakthrough in PIL cases came in 2007 when it successfully represented 3000 tobacco farmers[8] in a landmark case against BAT that resulted in a $2 million court settlement.[9] In 2008, the firm won another class-action case, this time against URA, having represented 100,000 motorists in the process.[10]

The firm started as a sole practice by Fred Muwema in 1998.[11] In 2000, Fred Muwema partnered with Herbert Kiggundu Mugerwa and rebranded the firm as Muwema & Mugerwa. Over the years the firm has grown into a limited liability partnership of five (5) Partners, one (1) Associate Partner and three (3) Senior Associates and six (6) Associates who are supported by a team of Legal Assistants and support Staff. Since its founding, the Firm has handled multiple transactions for domestic and multi-national entities in Uganda and internationally.[1]

Listed below, are some of the noteworthy cases steered by the firm:

  • in 2007, Muwema & Mugerwa successfully represented tobacco farmers in a suit against British American Tobacco, resulting into a court settlement worth 4.6 billion shillings (USD 2M).[8]
  • In 2008, Muwema & Mugerwa successfully represented 100,000 Ugandan taxpayers and undertook the refund of prepaid road license fees from Uganda Revenue Authority on behalf of the 100,000 tax payers.[5][10]
  • In 2009, Muwema & Mugerwa represented the Great Leader of the Libyan Jamahiriya, Col.Muammar Gaddafi in a defamation case against ‘’Red Pepper’’ a Ugandan Tabloid.[14]
  • In 2011, Muwema & Mugerwa represented Rock Petroleum (U) Ltd, in CIVIL APPEAL NO. 18 OF 2011 against Shell (Uganda) Ltd & 10 Ors.[15]
  • In 2012, Muwema & Mugerwa represented thousands of mobile telephone users in a landmark case against Uganda’s leading mobile telephone company, MTN.[6]
  • Also in 2012, Muwema & Mugerwa unsuccessfully represented thousands of Ugandan motorists in a case against KCCA over street parking fees.[7]

Criticisms[edit]

In 2011, Fred Muwema, the firm's founding partner, was interrogated by the Uganda Police Force, over billions of Shillings allegedly owed to Bunyoro tobacco farmers.[19] That was because in 2007, Muwema & Mugerwa had successfully represented these farmers in a suit against British American Tobacco, resulting in a USD 2M court settlement. The money was reportedly paid into Fred Muwema's account for transfer to the farmers, some of whom were then demanding for payment. He is alleged to have paid some of the 2000 farmers, leaving out others, who were then threatening to demonstrate.[19]
