Harihara Arun Somasankar
Harihara Arun Somasankar is an international lawyer. He has appeared in various sensitive cases namely offences committed by Terrorist Organisation, Sexual Offences against a Minor Child, Murder, Illegal Manufacturing of Drugs, and other major offences against the State.
Early life[edit]
Born into a Tamil family, Harihara's father S.Gomathi Nayagam is the Senior Counsel and was the former Additional Advocate General for the State of Tamil Nadu. His grandfather, Mi. Pa. Somasundaram was an eminent Tamil journalist, poet, writer, and musicologist. His mother is S.G. Rajanandini.
Education[edit]
He completed his law degree from ILS Pune University. His thirst for knowledge ad yearning to know more, Harihara pursued various programs such as INSP at Stanford University, ISIP at Oxford University, GDL(United Kingdom), PG Cyber, PG Corp, DCMA, DBL, DCL, DIPR, and DPCL. While pursuing his career in the United Kingdom, at Cardiff University, he was elected as Students’ Union Representative.
Cases Handled[edit]
- He appeared on behalf of the State of Tamil Nadu against Karti Chidambaram's plea to transfer of tax evasion case[1]
- He appeared on behalf of the Tamil Nadu Dr M G R University in various cases especially against SVS Medical College case in which few medical college students were subjected to Sexual Harassment.
- He took up the high-profile cases of Power Star Srinivasan and Mahanadhi Shobana.[2] He is closely involved with Domestic and International Law, practice and policy. He gained professional experience in international and Indian law. On 04.01.2018 he was appointed as the Government Advocate(Prosecutor) for the State of Tamil Nadu[3]
Achievements[edit]
- In a Criminal case, Hon’ble High Court of Madras has accepted his interpretation with reference to section 108,109 and 122(1)(b) of Criminal Procedure Code and the Hon’ble Court has held that ‘as regards the execution of bond for good behaviour under section 108 and 109 of criminal procedure code the framers of law could not have intended the sections to loosely hang in the statutory hanger, as the execution of bond entails the enforcement of the same. Maybe it was an accidental omission, which can be supplemented by purpose interpretation of the statutory schemes as a whole. From the scheme of the chapter under consideration, this court safely infers that there was no intentional omission by the parliament to render the said provision impotent to ineffective and in such situation, the court can play a supplementary rule in giving effect to otherwise the intention of the farmers so as to give force and life to the intention of the legislature as expressed by Lord Denning J.’ Also, the Hon’ble Court has recorded its appreciation for his out of box approach and perspective(paragraph 32 of the judgment)[3]
- Harihara Arun somasankar is the Youngest Indian to be appointed as the Legal Advisor for International Court.[4] [5]
- Appointed by the Tamil Nadu government as a pleader among 103 officers[6]
- Member of Training Committee in International Criminal Court Bar Association and Took responsible for the design and implementation of advocacy training, and training in procedural and substantive international criminal law and information technology systems for all ICCBA Members.[7]
