Joe Biden was sworn in as the 46th president of the United States on January 20, 2021. As at January 25, 2021, he has not granted executive clemency to any individuals charged or convicted of federal criminal offenses, as authorized under Article II, Section 2 of the Constitution.

Background[edit]

The U.S. president's power of clemency arises from Article II of the United States Constitution. Clemency "may take several forms, including pardon, commutation of sentence, remission of fine or restitution, and reprieve",[1] with the two most commonly used forms being a pardon or commutation. A pardon is an official forgiveness for an acknowledged crime. Once a pardon is issued, all further punishment for the crime is waived.[2] The president can only grant pardons for federal offenses.[3] When the president commutes a sentence, it reduces the severity of a sentence without vacating the conviction itself; for example, a commutation may reduce or eliminate a prison term, while leaving other punishments intact.[1]

The power of clemency is "one of the most unlimited powers bestowed on the president by the Constitution."

The Office of the Pardon Attorney, an office within the United States Department of Justice, assists the president in the exercise of executive clemency.[4]
